AAPCHO Condemns Trump Administration Proposed Rule to Reverse Health Care Discrimination Protections

WASHINGTON – The Association of Asian Pacific Community Health Organizations (AAPCHO) today released the following statement, denouncing the Trump administration’s proposed changes to the Health Care Rights Law or Section 1557 of the Affordable Care Act (ACA).

“AAPCHO strongly condemns the Trump administration’s continued assault on our health care system and its proposed rule to eliminate key nondiscrimination protections contained in the ACA’s section 1557, also known as the Health Care Rights Law. Section 1557 protects people against health care discrimination on the basis of sex, race, color, immigration status, gender identity, age, or disability. The administration’s proposed rule significantly lessens these protections and will have a detrimental impact on all individuals currently protected by Section 1557. Proposed changes will disproportionately affect women, members of the LGBTQ community, and individuals who are limited English proficient (LEP).

The administration’s proposal threatens access to vital services for the most underserved communities. Harmful proposed changes include stripping protections for individuals who are LEP and eliminating requiring taglines on significant documents to inform LEP individuals where they can turn for assistance. The administration’s dangerous proposal rolls back these protections and will endanger those who are at most risk of discrimination, including many Asian American, Native Hawaiian and Pacific Islander patients and their families.

The rule will not go into effect immediately and proposed changes are open for public comments before they become final and can take effect. AAPCHO opposes this proposed rule and urges the public to join us in rejecting its harmful attacks during the 60-day comment period. The administration must rescind this rule and maintain the existing protections.”
